General Terms and Conditions

1. General

All our deliveries and services are provided exclusively on the basis of these General Terms and Conditions. Deviating conditions of the purchaser require our consent. We supply exclusively for commercial requirements. Over-deliveries or under-deliveries of up to 10% are sometimes unavoidable for promotional items with custom branding and are considered agreed. However, exact-quantity delivery is the standard.

2. Offers

Our offers are always non-binding, subject to change, and subject to availability. Orders are deemed accepted when we send you an order confirmation or deliver the ordered goods. We reserve the right to supply our items only in standard commercial quantities.

3. Illustrations and Product Descriptions

Illustrated decorative items are not included in the scope of delivery. Technical modifications as well as changes in shape, color, and material remain reserved. We reserve the right to make minor deviations from the product illustration. Information regarding weight, dimensions, capacity, performance, color, etc., are approximate values only.

4. Prices

All prices are net prices, ex-works (excluding freight), and are subject to statutory value-added tax. Should extraordinary fluctuations in raw material and foreign exchange rates occur, we reserve the right to make price corrections. Up-to-date daily prices can be found at www.bettmer.de.

5. Promotional Branding

If details regarding size, positioning, and color are missing, we reserve the right to apply the branding to the item according to suitability. Exclusively the digital proofs created by us are binding, whereas sample illustrations in the catalog and online shop are not.

6. Shipping Costs

Shipping costs are calculated per order. We calculate shipping costs based on the order value (including printing costs, if applicable):

• For particularly bulky or oversized shipments, we charge a freight surcharge of €20.00.
• International shipping costs are calculated based on weight.

7. Delivery

Items without promotional branding are generally delivered promptly within a few days. Items with promotional branding are generally deliverable within approx. 8 to 10 working days. Partial deliveries are avoided whenever possible, but remain reserved for us. Regulation of previous partial deliveries within the framework of our payment terms cannot be refused due to backlogged quantities. The delivery week confirmed by us is an estimated delivery date and applies to dispatch ex-works. Fixed delivery dates apply only after explicit written confirmation by us. In the event of negligent delivery delay, claims for damages are limited to the amount of the price difference for substitute procurement. Further claims for damages are excluded.

We shall not be liable for damages, losses, costs, or expenses resulting from any delay, restriction, impairment, or non-fulfillment of an obligation under this contract caused by a circumstance constituting force majeure.

A case of force majeure includes, in particular (but not exclusively), natural disasters, epidemics (such as SARS-CoV-2), floods, fire, explosion, war, civil unrest, terrorism, riots, strikes, lockouts, general energy and raw material shortages, failure of public utility services, unforeseeable blockage of transport routes, or orders by law or by competent authorities, in each case provided that we are not responsible for them.

If we are unable to meet binding delivery deadlines for reasons beyond our control (non-availability of performance), the agreed delivery dates shall be extended by the duration of the impediment. We will inform you immediately about the cause and effects of the force majeure and simultaneously communicate the expected new delivery period. If the performance is also not available within the new delivery period, you are entitled to withdraw from the contract in whole or in part; in this case, any consideration already provided will be refunded by us immediately. Cases of non-availability of performance in this sense include, in particular, (i) cases of force majeure, (ii) untimely self-supply by our suppliers if we have concluded a congruent hedging transaction.

8. Right of Return

If an item does not meet your expectations, you can return it within 20 days. The prerequisite is that you return the goods to us unused, in flawless condition, and in their original packaging. Please understand that items with custom promotional printing are excluded from the right of return. Your statutory warranty rights for these items naturally remain unaffected.

9. Payment

Within 20 days net, without cash discount deduction. The delivered goods remain our property until full payment has been received.

10. Warranty

Statutory warranty rights apply.

11. Data Protection

The processing of personal data is carried out fundamentally in accordance with data protection regulations and laws. The data necessary for transaction processing is stored, processed for our own advertising purposes, and your name, title, and address data may be passed on to selected companies if we believe their offers will be of interest to you. During data processing and transmission, your-worthy interests are taken into account in accordance with statutory provisions.

12. Place of Jurisdiction

The place of jurisdiction is Darmstadt.

13. Notice Pursuant to the Battery Ordinance

Batteries must not be disposed of in household waste. All end consumers are legally obligated to return used batteries to a collection point (anywhere batteries of that type are sold or public collection points). You can also return batteries that we distribute to us free of charge in standard consumer quantities. Harmful substances in batteries are labeled as follows: Pb stands for lead, Cd for cadmium, and Hg for mercury. Please tape the terminals of lithium batteries before dropping them off to prevent short circuits.
